Is fashion copyright-able?

Is fashion copyright-able?
An interesting debate. Can a design really be subject to copyright? It seems fashion has no code. And should it? Would you stifle the creativity of designers by restricting their designs with the possibility of prosecution because it is too similar to someone else's?

Hmm but then I come back to the fact that copying is just not right. We here in the Polyvore community get antsy when our sets are copied by others.

These 2 dresses were probably made in the same city (Shen Zen, China) so why the different price tag?

Ok or not?

Creative v unethical?
I am not sure how I feel about this subject, I thought it an interesting one to raise to the Polyvore community. I will admit I have bought knock offs before. I guess seeing the garments side by side like this makes it seem wrong! Legally designers may have a hard time pursuing this, read about copyright in fashion on the net and it is a murky area. And it could be argued that designers charge outrageous prices for their garments (all the while having them made cheaply in foreign countries, paying workers a pittance per garment). So why shouldn't the average person have access to beautiful designs at affordable prices? It is such an interesting debate!!!! What do you think?
